Terms and conditions of sale and use

These terms apply to the use of this website and to any service ordered from Blue Digital, including when it is paid online by card.

1. Purpose and acceptance

These terms govern the use of the website and the relationship between Blue Digital (the "Provider") and any person, business or individual, who requests a quote or orders a service (the "Client").

Any order, whether accepted in writing, by email or by an online payment, constitutes unreserved acceptance of these terms. Specific conditions on a signed quote prevail over these terms in case of conflict.

2. Services

Blue Digital provides, among other things:

  • emergency fixes for websites, online stores, ERPs, applications and servers;
  • takeover and maintenance of existing projects;
  • custom module and feature development;
  • technical SEO audits and fixes;
  • artificial intelligence projects applied to business operations;
  • monthly maintenance contracts.

3. Quotes and orders

Each service is covered by a written quote stating the scope, price, payment terms and, where possible, an indicative timeline. For emergencies, the price is given after diagnosis and before any work starts.

The order becomes firm when the written acceptance of the quote or the requested payment (deposit or full amount, as per the quote) is received. The quote states how long it remains valid.

4. Prices

Prices are expressed in Moroccan dirhams (MAD). The quote states whether they exclude or include tax; VAT is applied at the current rate.

The amounts shown on online payment requests match the relevant quote or invoice exactly.

5. Payment terms

Online payments are confirmed by an email stating the amount, the transaction reference and the service concerned. An invoice is issued for every payment.

  • Emergency fixes: payment once the website or application is back in service, after a live demo of the result.
  • Projects (takeover, development, SEO, AI): 10–15% deposit on order, balance after a live demo of the result, unless the quote sets a different schedule.
  • Maintenance: monthly payment, as per the contract.
  • Accepted methods: bank card (Moroccan CMI cards, Visa, Mastercard) on the CMI secure payment page, including via a payment link sent by email or WhatsApp; bank transfer.

6. Online payment security

Card payments are processed exclusively by the Centre Monétique Interbancaire (CMI) on its secure page (encrypted exchanges, 3-D Secure authentication where the cardholder’s bank offers it).

Blue Digital neither receives nor stores full card details (number, expiry date, security code). Only the information needed to track the transaction (reference, amount, date, status, payer name and email) is passed on to it.

The Client warrants that they are fully authorised to use the card used for payment.

7. Delivery of services

Timelines are indicative unless expressly committed to in the quote. They depend in particular on the Client providing the necessary access and information.

Every service ends with a live demo of the result. The Client may report any issue found during this demo.

Deliverables (code, documentation, access) are handed over once full payment has been received.

8. Client obligations

  • provide accurate information and the necessary access (server, admin panel, code repository, hosting);
  • hold the rights to the platforms, content and accounts concerned;
  • appoint a contact person to approve each stage;
  • keep their own backups, in addition to those Blue Digital makes before any work.

9. Right of withdrawal

Where the Client is a consumer concluding a distance contract, they benefit from the withdrawal period provided by Moroccan Law No. 31-08 on consumer protection.

Under that law, the right of withdrawal can no longer be exercised for a service whose performance began, with the consumer’s agreement, before the end of the withdrawal period. This is usually the case for emergency fixes, which are requested for immediate performance.

The right of withdrawal does not apply to business Clients.

10. Cancellation and refunds

Cancellation and refund conditions, including for card payments made through the CMI, are set out in our cancellation and refund policy, which forms an integral part of these terms.

11. Liability

Blue Digital has an obligation of means. It cannot be held liable for malfunctions caused by elements outside its work: hosting provider, third-party services, vendor extensions or modules, changes made by the Client or another provider.

Except in case of gross negligence, Blue Digital’s liability is limited to the amount paid for the service concerned.

12. Intellectual property

Code developed specifically for the Client and the related deliverables are assigned to the Client once full payment has been received. Third-party components (frameworks, libraries, extensions) remain subject to their own licences.

Blue Digital may name the Client and show a screenshot of their website in its references, unless the Client objects in writing.

13. Confidentiality and personal data

Blue Digital undertakes to keep confidential the information and access provided by the Client. A specific non-disclosure agreement can be signed on request.

14. Complaints

Complaints can be sent to contact@bluedigital.ma or by phone on +1 (929) 224-5008, quoting the quote, invoice or transaction reference. Blue Digital undertakes to respond as quickly as possible.

15. Governing law and disputes

These terms are governed by Moroccan law. In case of dispute, the parties will first seek an amicable solution. Failing that, the courts of Rabat have jurisdiction, subject to mandatory provisions applicable to consumers.

16. Changes to these terms

Blue Digital may amend these terms. The terms applicable are those in force on the date of the order.
